Robert Downey Jr. Not Charged This Time

The Los Angeles County District Attorney's office announced on Monday that it was not going to pursue criminal charges against Robert Downey Jr.
In what has been received as somewhat surprising news, California prosecutors announced that Robert Downey Jr. would not be prosecuted for his most recent arrest in Culver City, California on drug charges. Officers arrested Downey after witnessing him acting erratically in an alley and their suspicions were later confirmed when Downey tested positive for cocaine.

Prosecutors, however, have opted to handle the infraction as a parole violation, which they say offers a much better chance for a stiffer punishment, including more jail time. State corrections officials will now have the option of confining Downey to a drug rehab facility for an extended period of time or sending him into the California penal system for some hard time. Despite this latest disaster, the Ally McBeal star was able to shoot some scenes for the season finale and that episode is expected to be his last on the David E. Kelley set. Calista Flockhart has made no secret of her distaste for Downey's inability to avoid trouble and fans are waiting anxiously to see how Kelley will incorporate Downey's anticipated hiatus from the show.

Depending on the ruling of the corrections officials and an upcoming hearing for a previous arrest on controlled substance possession charges, it could be a long time before anyone sees RDJ outside a rehab facility or a prison. The waste of talent in this situation is a shame, but the true tragedy lies in Downey's physical inability to combat his disease of addiction.
