The man who Elizabeth Hurley claims is the father of newborn son has gone to court in Britain, challenging Hurley’s paternity claim. Stephen Bing, 37, hasn’t outwardly stated that he is not the father, but claims that he just wants to be absolutely sure. The U.S.-born Bing filed legal action on Wednesday. No word yet on what he is seeking, but it is assumed he will request a DNA test. He has stated he did not want to settle things in court, but couldn’t contact Hurley to discuss things privately.

The word from Hurley’s camp is that she has not heard a word since she went into labor. Her sister informed Bing of little Damien’s birth on April 4. Hurley’s publicist released a statement, "He has neither called her, written to her or had any mutual friend pass on any messages." It has been reported that Hurley is "extremely distressed" by Bing’s actions. As reported on Eonline.com, Bing states he is, if proven to be the father, ready to "generously…support" little Damien Charles and "be involved in his upbringing."

Hurley and Bing met in 2000, shortly after her split from long-time love, Hugh Grant. The pair was linked until she announced her pregnancy in late 2001. Then Bing began saying that the relationship was not exclusive. This took Hurley by surprise. She claims she was "completely loyal and faithful" during their 18-month relationship. They had little to no contact during her pregnancy, and Grant stepped in and lent his support during her pregnancy. She has currently taken up residence at the home of Elton John, who has also been named the godfather to her son.
