A person's record should be totally blocked from everyone except the US government, just like IRS records. Easy access to public records over the internet is an invasion of privacy. if a person thinks he or she is dating or about to employ a person with some kind of criminal background, there should be a judicial process in place to extricate those records. If there is a record, that's proof that the person has already paid for his/her crime to the satisfaction of the community, so what is the point of dredging up an old background? Some people do change, mature, become wiser, more settled, whatever with time. So a negative background should not trouble what they do in the present. And even if they are unreformed as to their original nature, the red flags will be abundant. Trust your intuition...a background reveals nothing about what a person is or will be like today.
Is there anyone who is without sin? Some of us have never gotten caught, or maybe our particularly crime is not codified as a "crime" yet. Should adultery be codified? It is a crime against the sanctity of marriage and crime against the children in a family. Should 35 percent annual interest rates (wasn't that once called loan sharking?) be codified?
And now to the issue of protecting our young children? Well thanks to the proliferation of internet child porn, the pedophiles are proliferating as well. I've known cases where person's without a background committed their first acts of pedophilia with friend's children. What with that? It is up to individual parents to protect their own children and supervise their children with people they don't know that well.
