Roach was arrested in Abilene, Texas on March 22 and charged with three counts of aggravated assault against a minor under the age of 13. Judd said in a statement on her Website, "I am obviously devastated. Our family will pull together, begin the healing process and hopefully – by the Grace of God – become stronger. We will move forward with our faith, family and our friends to find resolution to this difficult situation." Roach has reportedly been seeking treatment at the Shades of Hope Treatment Center in Buffalo Gap, Texas for his addiction to drugs and alcohol.

Judd filed for divorce in Williamson County Chancery Court and cited irreconcilable differences and stated the couple was "unable to live together successfully as husband and wife." The couple has been married for three years and they do not have any children together. Judd has two children – 12-year old Elijah and 10-year old Grace – from her first marriage to Arch Kelley III.

Roach checked into rehab three days after the couple separated. He was Judd’s bodyguard for 10-years and also her road manager before they were married in November 2003. Roach, 49, is set to be returned to Nashville where he will reportedly be formally served with the sec crimes indictment. Police spokesman Don Aaron said, "The indictment is the result of an investigation by the Metro Police Department’s sex crimes unit that began in late February of this year." Roach is currently being held on $750,000 bail and is being held in Taylor County Jail in Abilene, Texas.
