Next, the American partner must file form I-129F Petition for Alien Fiancé (e) for the spouse and children. The petition, along with supporting documents and a copy of the receipt notice (Form I-797) of the earlier filed Form I-130F must be sent to the USCIS. These are important processes as the foreign spouse who applies for the K3 nonimmigrant visa needs to have a petition filed on his/her behalf by the American spouse.
