It was reported that Stapp returned to his Boca Raton home on Sunday morning at approximately 8 a.m. after a night of heavy partying and was confronted by his wife, former Miss New York USA 2004 Jaclyn Nesheiwat. Stapp reportedly became upset by her questions about where he went and allegedly snapped. Sheriff’s spokesman, Paul Miller, said, "He got angrier and allegedly threw a glass bottle of Orangina, almost hitting her in the right side of her face. She was in fear at that point that he might do something else, so that’s when Palm Beach County deputies were called to the scene."
Stapp was originally arrested with one count of assault with intent to commit a felony. The charge was reduced to a misdemeanor on Monday. The charge was reduced by Judge Cory J. Ciklin because, "based on the circumstances, the defense attorney argued that was not a deadly weapon." He was released on Monday on "supervised release" and will reportedly be subject to random drug and alcohol testing. The singer has also been barred from contacting Nesheiwat, who said that they had been going through a "rough time."
Stapp’s record label said, "This is a private matter between the members of the Stapp family and we would hope that their privacy is respected. Scott and Jaclyn are both well, and any further relevant information will be forthcoming at the appropriate time." Stapp and Nesheiwat were married in February 2006. Stapp was arrested the very next day for public intoxication. Maybe that was a sign of what was to come…The couple welcomed their daughter Milan in January 2007.
