Evans and Schelske agreed to stop discussing their impending divorce or any allegations with the press. They also discussed visitation rights for their three children – Avery, 7; Olivia, 3; and Audrey, 2. Schelske is currently under a restraining order and is not permitted in the family home and petitioned the court to let him move back to their house. He claims all allegations of abuse and adultery were false and that he has not seen his children since October 12, the date Evans filed for divorce, and had only spoken to them once on the phone. Anne Russell, Schelske’s attorney, said, "Mr. Schelske has been evicted from his home and we do not see a single indication that there is a danger to anyone." Judge Robert E. Lee Davies denied the request citing tension as the cause. Davies said, "By the nature of this proceeding, there is tension here and there will be tension in the home and the children are going to feel that."

Evans and Schelske opted to divide their joint bank account in half and Schelske was to use his half to find a new residence. Evans will maintain primary custody of their children and Schelske will have visitation rights. The couple also agreed not to talk to the press, not to physically or verbally abuse each other, and both will submit to a psychological exam.

Evans suddenly filed for divorce on October 12 claiming that her husband claiming that he had abused her, cheated on her with their friend and former nanny Alison Clinton, and of watching pornography in front of their children. Schelske denied all claims and came forward with some claims of his own. He alleged that Evans had an affair with her Dancing with the Stars partner Tony Dovolani. Both Evans and Dovolani denied that they had had an affair. Schelske also claimed that Evans suffered a nervous breakdown last year. Now it is just a case of he said, she said.
