On Thursday, Superior Court Judge Denise de Bellefeuille threw out two of the twelve allegations made against Lowe by his former nanny. The two allegations had to do with labor code violations, but the sexual harassment claims remain. The labor code violations were reportedly thrown out because there was no legal basis for the claims. Lowe’s attorney, Larry Stein, said, "We’re very please with today’s outcome. The Lowes have consistently denied any wrongdoing and will be vindicated. The entire family is holding up as best they can."
John West, Gibson’s lawyer, said, "We don’t consider this a setback at all, Jessica’s case is still intact as a whole." He said of Gibson, "She’s been lying low. This has been a very traumatic situation for her, she’s doing her best to heal." Neither Lowe nor Gibson was in court on Thursday. The next hearing has reportedly been set for July 10.
Gibson, 24, worked as a nanny for Lowe and his family for seven-years. She claims that over the course of those years the Brothers & Sisters star groped her and exposed himself. Lowe has denied all the allegations. He has also stated that Gibson quit her nanny position three times only. On April 7, a week before Gibson filed suit, Lowe came forward and said that she had demanded $1.5 million from the actor and his family to keep her silence. He filed a million lawsuit against her claiming that she threatened to "damage and humiliate" his family. He also filed suit against two other former employees accusing them if breach of contract, defamation of character and intentional infliction of emotional stress. Another former nanny has come forward and accused Lowe’s wife of sexual harassment, a claim that has been denied by Lowe’s camp.
