A rep for Witherspoon and Phillippe first announced their separation on October 30 after seven years of marriage and two children. Witherspoon, 30, filed for divorce Wednesday and is seeking physical custody of her children Ava, 7, and Deacon, 3, with visitation rights for Phillippe, 32. She has also asked that Phillippe not be granted spousal support. In the court papers, Witherspoon lists the date of separation as October 30 and signed the divorce papers on November 7. The couple did not sign a pre-nup before their marriage, which means all earnings acquired during the marriage will be split evenly.

The two split amid rumors of hard partying, drug use, and infidelity on Phillippe’s part. It was reported that Witherspoon found out that Phillippe had been having an affair with actress Abbie Cornish. Phillippe and Cornish met on the set of their indie film Stop Loss and were reportedly spotted getting very friendly off the set. A source on the set said the two had a "fling," but her rep has denied the claims saying, "It’s not true. They are co-stars and that is it." Neither Witherspoon nor Phillippe have commented on the infidelity claims.

Phillippe did issues a statement to People magazine earlier this week saying, "I’m not a perfect person, but I’m not guilty of a lot of the things I have been accused of. My priority is and always has been the health and safety of my family." Reports of hard partying and drug use have been repeatedly denied by his reps. Witherspoon and Phillippe met at her 21st birthday party and were married two years later.
