Hilton was taken from the courtroom after the surprise ruling crying and screaming. She reportedly yelled, "It’s not right!" And then called out, "Mom!" Hilton had been transported to the court hearing in sheriff’s custody on her early release from jail. She was placed in the black and white cruiser outside her home and it was reported that she was in handcuffs. Hilton began crying as the cruiser sped away dodging the paparazzi and Hilton’s many fans. Hilton’s mother, Kathy, reportedly said, "It is what it is and it’s in God’s hands now."

Judge Michael Sauer granted the court proceeding after the Los Angeles City Attorney requested a hearing to demand that Hilton be returned to jail for the remainder of her sentence. Hilton was originally sentenced to 45-days in the Century Regional Detention Facility in Lynwood, California. Before even beginning her sentence it was reduced to 23 days. Hilton turned herself in on June 3 to begin serving her sentence. On Thursday Hilton was reassigned to home detention due to a non-disclosed medical condition. She was fitted with an electronic monitoring device and sent home on the condition that she must serve her entire 45-day sentence less the days she had already spent in jail.

After her release, many were outraged and cried foul saying that Hilton was getting specialty treatment since she is a celebrity. Sheriff Lee Baca made the decision to transfer Hilton to home detention and stands by his decision saying that it was based on medical advice. Baca said, "It isn’t wise to keep a person in jail with her problem over an extended period of time and let the problem get worse." Whatever the case it has been reported that Hilton will now have to serve her entire sentence of 45 days in the Century Regional Detention Center.
