Notice to Vacate Rental Property

Looking for a notice to vacate rental property sample, to write one of your own? Here's an article on how you can go about writing one, followed by the basic eviction notice template...
Let's face it, the property you rented out to your present noisy and trouble-making neighbor is without a shred of a doubt, yours. You have the final say on who can occupy himself or herself in there. You ought to be able to decide who you want to let you bugger you up over the rent. So if you have a lessee who just isn't working for you, and is simply out-and-out annoying with his late rent payments and noisy parties which start in the middle of the night and don't stop till the cock crows in the morning, it is perhaps only in your best interests that you chuck out the source of this entire menace out without a second thought. How? A very crucial part of this whole procedure is to start by dishing out to him this notice to vacate the property you rented out to him and therefore asserting your no-nonsense type ownership over the piece of home which the lessee continues to defile.

How the Notice Should Be

The law of the land, and basic common sense and humane feeling says that while you are completely entitled to get this trouble making chap off your land, it is only fair that you serve a notice declaring your intentions in no uncertain manner before asking him to bundle up his belongings and take them along with his raucous personality somewhere else. The notice is a formal letter writing exercise, which you need to keep multiple copies of and file safely, so that you can brandish the thing in his face again if he 'accidentally' ends up losing it. This is simply to tell him that due to the reasons which have miffed you over his presence on your land in your life, you intend on asking him to vacate within a certain period of time. The period is generally a month. This leaves your lessee with 2 pretty in-your-face options. 1) He can do the right thing, stomach the blow and look around for a new place to live or 2) Be arrogant and completely ignore the notice letter, in which case you may issue court proceedings for evicting this troublesome fellow. The court of course will entertain your (the lessors) pleas only if you have sent this eviction notice and yet this person continues to ignore it. Hence I would like to state the importance of securing this document in a safe enough place.

Here are some writing tips to help you with it.
  • The language of this letter is decidedly formal. While your primal instincts may tempt towards writing an exceedingly expletives-ridden letter, it is best to exercise restraint and stick to the point in an impersonal sort of way.
  • The first paragraph emphasizes the importance of your position as the owner and the lord of the property. Introduce yourself in a way that the lessee takes you seriously. Make sure you have the copies of the tenancy agreement to make it look all the more official.
  • Specify the reason why you are taking this drastic step to un-house him. After all, he deserves an explanation.
  • Sign off by mentioning the notice period over which he may initiate his search for a new flat.
