Nebraska Senator Sues….GOD???

Nebraska Senator Ernie Chambers proves that you can sue anyone…even God.

Nebraska Democratic State Senator Ernie Chambers has decided to go straight to the top regarding the rising number of natural disasters plaguing the world. In a lawsuit filed on Friday afternoon in Douglas County Court, Chambers requests a "permanent injunction ordering Defendant to cease certain harmful activities and the making of terroristic threats". Chambers, "the duly elected and serving State Senator from the 11th Legislative District in Omaha, Nebraska," states that the "defendant directly and proximately has caused, inter alia, fearsome floods, egregious earthquakes, horrendous hurricanes, terrifying tornados, pestilential plagues, ferocious famines, devastating droughts, genocidal wars, birth defects and the like."

Chambers also asserts that God has caused "calamitous catastrophes resulting in the wide-spread death, destruction and terrorization of millions upon millions of the Earth’s inhabitants including innocent babes, infants, children, the aged and infirm without mercy or distinction."

The suit also claims that the defendant "has manifested neither compassion nor remorse, proclaiming that defendant will laugh" when calamity comes.

In Chambers’ opinion, his case is perfectly legal considering "that [the] defendant, being omnipresent, is personally present in Douglas County."

The lawsuit recognizes that God, the defendant, has a number of aliases, names, and designations. It also admits that the defendant is omnipresent. According to the lawsuit, Chambers said he's tried to contact God numerous times to no avail.

"Plaintiff, despite reasonable efforts to effectuate personal service upon defendant 'Come out, come out, wherever you are,' has been unable to do so,'" Chambers said.

In light of the peculiar circumstances of this case, Chambers requested that the court waive personal service. According to the suit, God should have actual knowledge of the action since He is omniscient. At least that solves the problem of finding a way to serve the required legal documents.

OK, obviously, Chambers isn’t serious. Through this lawsuit, he has, however, made a point against other senators promoting bills that allow the filing of frivolous lawsuits.

"The Constitution requires that the courthouse doors be open, so you cannot prohibit the filing of suits," Chambers says. "Thus anybody can file a lawsuit against anybody—even God."

According to reports, Chambers decided to file the lawsuit after a suit was filed in federal court against Lancaster County Judge Jeffre Cheuvront in early September. Cheuvront is the judge who was presiding over a sexual assault case in which the plaintiff "wanted to use the words ‘rape’ and ‘victim’ during her testimony".

Chambers has asked the court to grant him a summary judgment. As an alternative, Chambers wants the judge to set a date for a hearing as expeditiously as possible.
