Lindsay Lohan Sued in 2005 Crash

Raymundo Ortega, who was driving the van that Lindsay Lohan hit in a 2005 accident, filed a lawsuit against the actress on Thursday.

The lawsuit was filed on Thursday in Los Angeles Superior Court and Raymundo Ortega, the driver of the van she smashed into, now claims that she had a few too many cocktails at a lunch at The Ivy and smashed into his van. Ortega is suing La Lohan and The Ivy for negligence. Per the court documents on October 4, 2005 Lohan, who was 19 at the time, "consumed alcohol and became intoxicated" before speeding away while "looking over her shoulder instead of watching the road" and crashed into Ortega’s van. At the time authorities said that Lohan was not responsible for the accident. Leslie Sloane Zelnick, Lohan’s rep, said Thursday, "She was sober."

A sheriff’s spokesman said at the time that Lohan was an "innocent victim" and that Ortega had made an illegal U-turn in front of the actress. Ortega now contends that Lohan was driving recklessly and is seeking $200,000 in damages. Per the court documents Ortega is seeking compensation for "the loss of his automobile, lost wages, medical bills and pain and suffering." Last month, the owner of the van that Ortega hit sued Lohan. Grandeur, Inc sued Lohan in small claims court and is seeking upwards of $3,000 in damages.

Lohan is currently cooling her heels in rehab. She checked into the Promises Treatment Facility after a wild Memorial Day weekend. This marks the 2nd time this year that the 20-year old has entered a rehab facility. She is reportedly battling addictions to alcohol and drugs including OxyContin, Percocet, Vicodin, and Cocaine. Lohan will turn 21 on July 2 and is reportedly gearing up for her 21st birthday bash. Presumably she will enjoy a substance free bash….
