The Los Angeles City Attorney’s Office announced the formal charges Friday. Nick Velasquez, a spokesman for the City Attorney’s Office said in a statement Friday, "We have charged Mr. Sutherland with a second DUI offense in 10 years, which we believe constitutes a violation of the terms of his probation from his 2004 conviction." Prosecutors are seeking to get his probation from November 2004 DUI conviction revoked. Sutherland reportedly faces up to one year in jail and a $1,000 fine. If a judge rules that he violated his probation he can face up to an additional six months of jail time.
Sutherland, 40, was arrested early Tuesday morning on suspicion of drunken driving in Hollywood. Cops pulled the 24 actor over after he made an illegal U-Turn and he subsequently failed a field sobriety test. Sutherland was booked on misdemeanor DUI charges at the Los Angeles Police Department Hollywood station. He was released on $25,000 bail at approximately 5:42 a.m. He was also previously charged with drunken-driving counts in 1989 and 1993. Both of which he pleaded to lesser charges of alcohol-related driving.
Sutherland has hired attorney Blair Berk, who also represents Lindsay Lohan, to represent him. His arraignment is set to take place on October 16, but is not required to be in court on the day he is arraigned. The seventh season of Sutherland’s hit show 24 will begin in January. It has been reported that Sutherland’s latest run in with the law will not affect the show.
