Kevin Federline’s Attorney Seeks Remedy Against Britney Spears

Kevin Federline’s attorney Mark Vincent Kaplan is seeking a remedy from the courts over Britney Spears refusal to appear at a deposition.

Spears "called in sick" to a scheduled deposition with Kaplan on Wednesday. He said that Spears attorney called him on Wednesday morning, minutes from when she was to arrive at his office, that Spears was suffering from a "medical condition" and would not be in attendance. Kaplan also said, "But she was in fact out later that day and night. It’s not fourth grade where you get a doctor’s note and it’s all OK. She was ordered to attend. And if there’s a legitimate reason for her not to attend she would have to establish that."

Spears’ reported "medical condition" was supposedly "anxiety." She reportedly suffered from anxiety due to the paparazzi. Kaplan said, "If the paparazzi are something that are causing anxiety, that is something I would assume that she deals with most of her life. So I am not sure why that the paparazzi anxiety level happened to coincide with the fact that the court ordered her to appear to be cross examined." Kaplan reportedly declined to seek out a contempt of court ruling against the pop tart and stating all he wants is to get "facts." Kaplan was reportedly going to be cross-examining Spears under oath about her drug and alcohol abuse as well as whether or not she is a fit parent. With her track record it seems likely that is where the anxiety came from.

Kaplan reportedly said Wednesday that he was not angry that Spears did not show for the deposition. He said, "I can move forward with or without her. But there will be a request to the court to address some kind of remedy to what I see as a willful non-appearance." Spears and ex-hubby Federline have been embroiled in a bitter custody battle for the past year over their sons 2-year old Sean Preston and 1-year old Jayden James. They are reportedly set to appear in court again on January 23.
