Duff and Madden filed papers in Los Angles Superior Court on Thursday against Max "Doe" who is approximately 19 years old and David Joseph Klein, 50, who is Max’s roommate. Reportedly, Max moved here from Russia two years ago with the sole intent of "meeting and becoming romantically involved" with the actress. The court papers alleged that Max has "admitted to being ‘obsessed’ with her" and "has stated his intention of ‘removing his enemies’ (i.e. those who prevent him from being with her)." According to the papers, "[Max] has stated his belied that Hilary is in love with him and that Joel Madden stands in their way."
Klein claims that he is a celebrity photographer and has been the one to pass along Max’s "foreboding messages" to Duff. The court documents state, "Over the past six weeks, the defendants have engaged in an accelerated effort to make contact with Hilary, including visits to her neighborhood, to her mother’s home, to her boyfriend’s neighborhood…to Mr. Madden’s concert venue, and direct calls to Hilary’s manager."
It has been reported that Max has claimed he intends to purchase a gun and has "threatened to kill himself and engage in dramatic actions" to get Duff to notice him. He also "believes they belong together." Well, apparently she has noticed and in no way feels the same. Duff claims she has suffered from "substantial emotional distress" and is petitioning the court that Max and Klein must remain at least 100 feet away from her, Madden, and members of their family. A hearing is reportedly set for November 15.
