If you are in the real estate business and you are owed a commission, you may have had a difficult time collecting your commissions owed. This can be one of the most frustrating parts of the business. After all making sure you client is happy with his choice is the most difficult and important part of the entire process. And after all of our hard work, having difficulty receiving payment can be frustrating and painful. But on the bright side, if you have a contract or anything in writing this can be extremely helpful in collecting your monies.
There are many homeowners and apartment corporations that really don’t conduct business in a professional manner. Its is very unfortunate that there are people like this out in the world. After you receive payment you probably had to jump through several hoops and you most likely will be exhausted. You will realize in the end that you will never want to deal with these sorts of people again and you most likely should not do business with them again.
Here is a short list of items that should help you in your quest to receive some sort of payment.
If the owner is not responding to your phone calls or voice mail here is what you can do. Leave the owner a voice mail and send him a fax or email if you have his address. Let him know who you are and what you want. Even though he may not pay you, it will set the proper steps in motion.
This lets the other party know that you are not just going to roll over. You want your commission that is due to you. Whether or not he returns your phone call will be entirely up to him.
If you don't hear from the other party in 5 days you will want to put together a demand letter. You will basically be putting in writing what you stated to the other party over the phone. Many people believe you should just skip step "A". However, I believe that a phone call is very easy, doesn’t cost any money, and well, its worth a shot.
Depending on how much your invoice is, you may have an attorney write a letter for you. However, if you do a little research you should be able to write one on your own. Make sure you send it certified. He or a representative of his will sign for your letter.
C) If you don’t receive your payment within your time frame it may be time to go to the court house. This requires a filing fee but is worth it.
