Criteria for Disability Benefits in California
You need to have a fair knowledge about what criteria you fulfill or what all benefits you are in need of. For this, we are providing a few of the benefit programs which will not only help you to avail them but will also make your life easy. But before that, you need to know some of the criteria to apply for it. As per the information provided by the California's Employment Development Department (CA EDD) the person needs to fulfill following criteria.
- You are not able to do assigned work properly for at least 8 consecutive days.
- You must be working at the time the disability happened.
- Your earning should be at least $300 previously from which SDI deductions were withheld.
- You were losing your wages because of the disability. If you are unemployed then you must have been looking for work.
- In the early 8 days of your disability, you must be undergoing treatment from a licensed doctor or accredited religious practitioner. If you want to continue to get the treatments, then you need to be under the treatment of the doctor regularly.
- You must claim the benefits within 49 days of the disability otherwise you may lose the benefits.
- Your doctor, nurse, midwife or religious practitioner should give you a proper medical certificate of your disability. In case of a religious practitioner you need to get a practitioner's certificate from the SDI office which should be accredited by Employment Development Department.
Disability insurance benefits can be availed by the person if he/she is suffering from non-industrial injury, illness or due to some pregnancy related problems. These may be long term or short term disability benefits. The state provides three disability insurance plans.
- The first one is the State Disability Insurance benefit or SDI which most of the employees in California avail and are under the state's program. As this is managed by the same agency which manages the unemployment insurance benefits, hence, even if you are unemployed at the beginning of your disability, you might be entitled to state disability insurance.
- Second is Voluntary plan, which is a private plan and can be applied to the EDD by the employer and the employee. If majority applies for it, then the plan will be approved.
- The third and the last one is the Elective coverage plan which is applicable for employers and self-employed persons, including general partners, individuals in family employment who are not under the California Unemployment Insurance Code can get this cover.
Social Security Disability Benefits
Social security disability benefits is for all age groups. There are some criteria, like you should have paid all the social security taxes and the disability should be serious physical or mental as determined by the doctor and should be verified and agreed by the social security administrator. This benefit does not cover partial or temporary disability benefits. You might at least get supplemental security income if in case you have not paid the social security taxes.
