Rodriguez, 33, says that his marriage is "irretrievably broken" and seeks to have the pre-nuptial agreement Cynthia signed before their marriage is enforced. He has also requested that the accusations that he cheated on his wife be stricken from the records. In his filing he claims that his wife’s claims are "immaterial and impertinent and should be stricken." He also said that Cynthia is a "loving and nurturing mother" and he hopes they can come to their own custody arrangements.
Cynthia, 35, filed for divorce in Miami in early July claiming that Rodriguez "emotionally abandoned his wife and children" and "carried on extramarital affairs and other marital misconduct." In her filing, Cynthia Rodriguez is seeking primary residential custody of the couple’s children. She is also requesting that the custody be shared with Rodriguez. She wants to retain their $12 million home in Coral Gables, receive alimony, life and health insurance, private school tuition, and equal distribution of the couple’s assets.
The couple split amid rumors that Rodriguez had an affair with Madonna, 49. The Material Girl singer has denied the claims despite rumors that the New York Yankee had been making frequent late night visits to her home. Cynthia’s attorney claimed that Rodriguez had had "an affair of the heart" with Madonna. Her attorney said that this was "the last straw" for Cynthia. The couple was married in November 2002. Their first daughter, Natasha, was born in November 2004 and their second daughter, Ella, was born in April 2008 in Miami.
